Kempner & Partners represents Ansell in ongoing worldwide litigation against Reckitt Benckiser over IP condom dispute

Leeds-based intellectual property firm Kempner & Partners is acting for Ansell, one of the world’s leading manufacturers of condoms, in a UK patent infringement lawsuit against Reckitt Benckiser Healthcare UK.

Kempner & Partners has helped Ansell file a patent infringement lawsuit in the High Court in London, and is now involved in a battle that has been raging abroad over patented technology owned by Ansell in non-latex condoms.

The lawsuit is seeking to protect Ansell’s R&D investment into utilising patented polyisoprene technology. Ansell already has ongoing litigation against Reckitt Benckiser companies in the USA and Australia, and this new patent infringement action is the third in the past three years in its ongoing global strategy.

Ansell is requesting a permanent injunction to stop Reckitt Benckiser from infringing European Patent (UK) number 2 280 618. In particular, Ansell’s claim will seek an injunction to stop Reckitt Benckiser during the term of that patent, from importing the Durex Real Feel product into the UK, or advertising or selling it in the UK, without the consent of Ansell. In addition, Ansell is seeking damages and the payment of its legal costs of the action.

Richard Kempner, partner at Kempner & Partners (pictured), said: “The selection process against tough competition that Ansell went through before choosing us for this case was very thorough: we were certainly well tested by them in terms of our patent litigation expertise, track record, ethos and strategy.”
